TEXSEON Marketing is a full-service digital marketing agency specializing exclusively in AI-powered online solutions for tradesmen in the Pampa and Amarillo, Texas Panhandle regions. These Terms of Service (TOS) govern your use of our website, services, and commitment to the WYSIWYG (What You See Is What You Get) Promise of transparency and clarity.
1. Acceptance of Terms
By accessing or using any part of the TEXSEON Marketing website, or by engaging in any agreement to purchase services, you agree to be bound by these TOS. These terms constitute the entire agreement between you (the Client/Tradesman) and TEXSEON Marketing.
2. Our Service Commitment (The WYSIWYG Promise)
Our commitment is to deliver digital marketing services with predictable, fixed-scope, and transparent execution, focusing solely on results that matter to your business.
A. Pricing & Payment
- Upfront Investment Guide: All services, including the Foundation Site and our monthly KORE packages, are priced according to the WYSIWYG Upfront Investment Guide (Master Service Rate Card).
- Fixed Scope: The price for any service is a fixed fee for the specific scope of work outlined in the proposal or Statement of Work (SOW). Any work requested outside of the defined scope will require a formal change order and a pre-agreed-upon adjustment to the investment.
- Payment Terms: Payment terms are outlined in the SOW. For monthly retainers, payment is due on the 1st of each month. Failure to make payments within the specified terms may result in a temporary pause of service execution, including content creation and ad campaigns.
B. Execution & Strategy
- Phased Approach: All client engagements follow a structured plan, beginning with Foundational Stabilization (e.g., website build, hyper-local SEO setup) before progressing to Regional Expansion (e.g., content, social media).
- AI Tool Integration: We utilize AI tools, including Gemini for content drafting and NotebookLM for audit organization, to ensure efficiency in execution and maintain a high standard of output quality, as reflected in our competitive fixed pricing.
3. Client Responsibilities
To ensure the success of the campaign and adhere to the project timeline, the Client agrees to:
- Timely Access: Provide all necessary access credentials (e.g., website CMS, Google Business Profile, existing analytics) promptly upon project initiation.
- Content & Assets: Supply all required business assets, including high-resolution logos, specific service area details, and raw photos/videos of completed work required for content creation, especially for social media and case studies.
- NAP Consistency: Cooperate fully in establishing and maintaining a single, consistent Name, Address, and Phone Number (NAP) standard across all digital properties for hyper-local SEO purposes.
4. Ownership and Intellectual Property
- Client Assets: The Client retains full ownership of their existing intellectual property, including brand name, logo, raw photography, and customer data.
- Website & Content: Upon full and final payment for the Foundation Site or Tradesman Lead Machine package, the Client owns the design, site structure, and all associated content developed by TEXSEON Marketing.
- Agency IP: TEXSEON Marketing retains ownership of its proprietary internal tools, templates, processes, and the underlying AI strategies (Master Marketing Strategy) used to deliver the services.
5. Reporting and Performance
- Clarity in Reporting: Reporting will be laser-focused on the three core indicators a tradesman cares about: Lead/Call Volume, Local Map Pack Ranking/Visibility, and Cost Per Qualified Lead (CPL).
- Disclaimer of Guarantee: Digital marketing involves inherent risk and external factors (e.g., search engine algorithm updates, local competition) outside of our control. While we deploy best practices, TEXSEON Marketing does not and cannot guarantee specific numerical results (e.g., a “guaranteed #1 ranking” or a specific number of leads). Our commitment is to deliver the services and execution outlined in the SOW to maximize the probability of success.
6. Termination of Service
- Monthly Retainers: Either party may terminate a monthly KORE marketing retainer by providing thirty (30) days written notice. The Client will be billed for the current 30-day period.
- Project Fees: One-time project fees (e.g., website build, audit) are governed by the specific cancellation terms outlined in the SOW. Work completed up to the date of cancellation will be invoiced and due immediately.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, and any disputes arising under these terms shall be resolved in the courts of the Texas Panhandle region (Amarillo/Pampa).
